This chapter provides for the continued and enhanced administration and enforcement of the New York State Uniform Fire Prevention and Building Code (the "Uniform Code") and the State Energy Conservation Construction Code (the "Energy Code") in this Town. This chapter is adopted pursuant to § 10 of the Municipal Home Rule Law. Except as otherwise provided in the Uniform Code, other state law, or other section of this chapter, all buildings, structures, and premises, regardless of use or occupancy, are subject to the provisions this chapter.
This chapter shall be known as the "Unsafe Buildings Law" of the Town of Waterford. Unsafe buildings pose a threat to life and property in the Town of Waterford. Buildings and structures may become unsafe by reason of damages by fire, the elements, age or general deterioration. Vacant buildings not properly secured at doorways and windows also serve as an attractive nuisance for young children who may be injured therein, as well as a point of congregation by vagrants and transients. A dilapidated building may also serve as a place of rodent infestation, thereby creating a health menace to the community. Debris, rubble, scrap, abandoned machinery or equipment or parts of buildings left on the ground and not removed constitute a dangerous, unhealthy and unsightly condition. It is the purpose of this chapter to provide for the safety, health, protection and general welfare of persons and property in the Town of Waterford by requiring that such unsafe buildings be repaired or demolished and removed.
By the adoption of this Article, the Town Board of the Town of Waterford declares its intent to regulate, in a manner consistent with the interests of the citizens of the Town of Waterford, the dumping of garbage, rubbish, refuse and waste material on lands within the town. Garbage is a deleterious substance. Unattended, garbage dumps emit noxious odors and fumes, attract rodents and vermin and become breeding places therefor. The process of burning garbage causes smoke and oxidized garbage to be given off into the air which the community breathes. All of these conditions can adversely affect the development of the town unless they are properly and carefully regulated. Therefore, recognizing the above and the need for adequate regulation of these hazards, and in the exercise of its police power in this regard, the Town Board of the Town of Waterford does hereby enact this Article.
No person shall throw, dump, deposit or place or cause to be thrown, dumped, deposited or placed upon any town road or highway or park or within the limits of the right-of-way of such town road or highway or park or upon private or public lands adjacent thereto any refuse, trash, garbage, rubbish, litter or any nauseous or offensive matter.
The creation of any unreasonably loud, disturbing and unnecessary noise is prohibited. Said
noise shall be prohibited when it is of such character, intensity and duration or of any type or
volume that a reasonable person would not tolerate under the circumstances and that is
detrimental to the life, health or welfare of any individual or would cause or create a risk of
public inconvenience, annoyance or alarm.
No person shall receive or accept for disposal or deliver, dump or offer for disposal any refuse on any land or at any location, site or area in the Town of Waterford unless such land, location, site or area is a solid waste disposal site and has been licensed as such as provided hereunder, and no person shall operate any such solid waste disposal site unless the same has been licensed as provided hereunder.
Stormwater Management, Erosion and Sediment Control
The purpose of this chapter and Chapter 161, Zoning, Article XI, is to establish minimum
stormwater management requirements and controls to protect and safeguard the general
health, safety, and welfare of the public residing with in this jurisdiction and to address the
findings of fact in § 142-1 hereof.
Vehicles, Inoperable, Abandoned, Junk and Oversized
It shall be unlawful for any person, firm or corporation to store, deposit or abandon or to cause
or permit to be parked, stored, deposited, abandoned, or visible from the main traveled way of a highway or visible from an abutting property owner's land a junk vehicle on any street, highway, or real property within the Town of Waterford for a period in excess of seven days.
